Collective Bargaining
Who?
School employers and any exclusive representative for certificated employees must collectively bargain the teachers' contract.
What?
The mandatory subjects of bargaining listed in IC 20-29-6-4 are salary, wages, and salary and wage related fringe benefits, including accident, sickness, health, dental, vision, life, disability, retirement benefits, and paid time off (IC 20-28-9-11) are permitted to be bargained. A grievance procedure is permissible. The following items are no longer bargained: Supplemental Master’s Payments pursuant to Indiana Code Section 20-28-9-1.5, Teacher performance grants pursuant to Indiana Code Section 20-43-10-3, and Increases based on teacher performance grants pursuant to Indiana Code Section 20-43-10-3.
When?
School Corporations and the corporation Exclusive Representation may informally bargain before September 15th. Formal bargaining begins September 15th and must conclude by November 15th. For information about the public hearing prior to formal bargaining and the two public meetings, please read the Practioner's Guide to Bargaining and Impasse. If parties are unable to settle a contract and ratify by November 15th, then IEERB declares impasse and assigns a mediator. The mediator has 30 days to meet 1-3 times with the parties to settle the contract. If the parties have not settled at the end of the mediation period, then they must submit and exchange a last, best offer. At that time IEERB will appoint a factfinder. The factfinder will conduct an investigation and a hearing and will select one party’s last, best offer or a joint last, best offer as the parties’ collective bargaining agreement.
Pre-Impasse Mediation
IEERB will provide mediation services during collective bargaining when requested by the parties. The cost will be split by the parties. See IEERB’s Pre-Impasse Mediation Policy for more details.

Pre-Impasse Financial Consultation

IEERB Collection
IEERB collects information from parties throughout the Collective Bargaining & Impasse process. Parties are required to:
- Complete the School Employee Organization Affidavit by October 1 in Gateway.
- Complete the Bargaining Status Form I by November 16 in Gateway.
- Upload the ratified and signed teachers' contract by November 16 to Gateway (unless the parties are at impasse).
- Complete the Collective Bargaining Report by July 30 in Gateway.
